China Tightens Its Grip on Citizens’ Right to Leave

China is tightening controls on citizens leaving the country under new regulations that was released on July 31st and will take effect on September 15.

The new rules give authorities broader powers to prevent people from leaving China when they are considered a potential risk to national security, including in cases involving technology transfers and sensitive information.

The problem is not simply that exit bans exist. Governments may have legitimate reasons to restrict someone’s travel in serious criminal or national-security cases. The deeper concern is the lack of transparency surrounding these powers.

A person may have a valid passport, a plane ticket, and no obvious indication that they are under investigation—yet still discover at the airport that they are not allowed to leave. The government does not necessarily have to make the restriction clear to the individual in advance, leaving travelers with little opportunity to understand the reason, challenge the decision, or make alternative arrangements.

This effectively turns the right to leave the country into something that can depend on the government’s undisclosed judgment.

As China continues to expand the use of exit bans, the bigger question is not only who can be stopped from leaving, but how much power the government should have to make that decision without transparency or meaningful accountability.
